KATH CEO sues Kwame Adofo for GHC5 million in defamation case

The lawsuit, filed at the high court on Monday (27 May), accuses Adofo of making false and damaging statements that have allegedly tarnished the reputation of Prof Addai-Mensah

The chief executive officer of the Komfo Anokye Teaching Hospital (KATH), Prof Otchere Addai-Mensah has filed a defamation lawsuit against Lawyer Kwame Adofo, seeking damages of GHC2 million.

The lawsuit, filed at the high court on Monday (27 May), accuses Adofo of making false and damaging statements that have allegedly tarnished the reputation of Prof Addai-Mensah.

The statements in question were made publicly and, according to the suit, have caused significant harm to the plaintiff’s personal and professional standing.

Prof Otchere Addai-Mensah is seeking GHC5 million in damages and demands a retraction and apology from Adofo, who until December 2023 provided legal services for the Komfo Anokye Teaching Hospital (KATH).

“Plaintiff says that the post by the defendant on his Facebook wall has created a great dent in the plaintiff’s hard-earned reputation and he has even had to be called by the King of the Asante on the issue”, parts of the suit stated.

“Plaintiff says the false and reckless statements made by defendant continues to lower his esteem in the face of right-thinking Ghanaians and his integrity in the academia have been grossly affected”

The development follows an earlier petition issued by lawyer Adofo to President Akufo-Addo to remove Professor Addai Mensah from office.

Lawyer Adofo claims to possess substantial evidence of financial mismanagement and incompetence against the hospital’s CEO.

In an earlier interview with Asaase News, Adofo accused Professor Addai Mensah of misappropriating GHC300,000, which remains unaccounted for and breaching procurement processes.

These allegations, according to Adofo, highlight serious concerns regarding the CEO’s management, competence and integrity.

My petition was written to the president because he is the appointing authority,” lawyer Adofo stated.

“I made specific allegations against the said chief executive officer [of KATH] because I have evidence to firmly back the claims. The first allegation concerns GHC300,000 in cash that the CEO has not been able to account for. And as a concerned citizen, I petitioned the president because he said we should not sit idle when we see people committing offences.”

But the hospital had mounted a spirited defence for its CEO describing such allegations as unfounded and full of inaccuracies. Labour unions at the hospital have also warned against any attempt to remove the CEO from office.
