Prof Stephen Kwaku Asare, known popularly as Kwaku Azar, a Ghanaian attorney based in the United States has reiterated his call for the General Legal Council (GLC) to be scrapped.

He said the GLC has become a major impediment when it comes to the development of law in Ghana over the years.

“I think we need more people to be educated about the law and the constitution and governance and so one of the things that I will do is to dismantle the General Legal Council, that has been the biggest impediment to the development of our law,” Asare said on The Asaase Breakfast Show on Monday (16 May).

“They have monopolised legal education and they are not doing a very good job at it. I will send legal education back to the universities,” he told the host Kwaku Nhyira-Addo.

He added: “And then I will start rewarding the universities and then I will start rewarding the universities based on their ability to make their students pass the bar as well as based on their ability to do research that advances law and development.”

About the GLC

The General Legal Council(GLC)  was set up in 1960 by an Act to consolidate and amend the law relating to the Legal Profession in Ghana. The Legal Profession Act, 1960 (Act 32).

The scope of the Legal Profession Act includes organisation of legal education and upholding standards of professional conduct and discipline.

It is the main regulatory body for the conduct and administration of legal education and profession in Ghana.  By its setup, the council is empowered and authorized to determine the policy and focus of legal education and training as well as the regulation of professional legal practice and ancillary matters.

The serving Chief Justice is the Chairperson of the Council, and the Judicial Secretary is its Secretary together with other appointed members including the three senior most Supreme Court Justices, the Attorney-General and her nominee, the President, Vice and Secretary of the Ghana Bar Association and the Ashanti Regional Bar President.

Conventionally, the General Legal Council on every first Friday of October, convenes a formal meeting to enroll and call to the Ghana Bar, candidates who have successfully passed the Professional Law Examination.

The membership of the Council reflects a balance between academics, legal practitioners and judges which represents the various facets of legal education, training and practice.
