Court dismisses case challenging legality of sim card re-registration

The high court case, which was filed by Francis Kwarteng Arthur, prayed the court for an order, inter alia, to stop the ongoing sim card re-registration exercise

The High Court Human Rights Division in Accra presided over by Her Ladyship Barbara N Tetteh-Charway on Wednesday (13 July 2022) dismissed a case challenging the legality of the ongoing sim card re-registration exercise.

The case, which was filed by Francis Kwarteng Arthur, prayed the court inter alia for an order to stop the sim card re-registration exercise. 

The court held that the sim registration directive by the National Communications Authority is lawful and in the public’s interest and that none of the NCAs actions violated any law. This follows the dismissal of an injunction application filed by lawyers for the applicant late last year.

It will be recalled that the same court on 9 December 2021 struck out the application for an interlocutory injunction to halt the sim card re-registration.

The decision to withdraw the application for an injunction by Kwarteng Arthur followed the filing of an affidavit in opposition by the NCA, which stated among other things that the current sim re-registration exercise is backed by law.

The re-registration exercise will end on 31 July 2022.
