Defamation case: Anas will have a tough time with appeal, says Samoa Addo

An Accra high court on Wednesday dismissed a GHC25 million defamatory suit by the investigative journalist against the MP for Assin Central in the Central Region. Anas took the MP to court in 2018 for allegedly defaming him

Private legal practitioner Nii Kpakpo Samoa Addo has commended the judge who ruled on the defamation case brought by investigative journalist Anas Aremeyaw Anas against Assin Central MP, Kennedy Agyapong, describing the ruling as “thorough.”

The court on Wednesday dismissed a GHC25 million defamatory suit by Anas against the lawmaker. In his application, Anas prayed to the court to award aggravated damages to compensate for alleged defamatory material published against him by Agyapong.

Justice Eric Baah held that Anas failed to prove that Agyapong defamed him by airing the documentary Who Watches the Watchman?

Anas has since served notice of appealing the judgement against him.
Appearing on Asaase 99.5 Accra’s news analysis show, The Forum, on Saturday (18 March), Addo said: “For those jumping ‘appeal, appeal’ it doesn’t work that way.”
“There must be specific pieces of evidence that must’ve been looked over but this judge took his time,” Addo said.

“The fact that you’re trying to give an explanation to what is before the court does not mean the court is bound by it, especially when you have failed to bring contrary evidence. You cannot then blame the court,” he said..

“The court actually considered every argument under the sun.”
