We could use ADR to resolve galamsey issues, says Supreme Court nominee

Justice Ackah-Yensu was answering a question from the Minority Leader, Haruna Iddrisu on what she thinks should be the judicial attitude to fighting the galamsey menace

A Supreme Court nominee, Justice Barbara Frances Ackah-Yensu has said the country could use the Alternative Dispute Resolution (ADR) mechanism to resolve galamsey issues in the country.

Justice Ackah-Yensu was answering a question from the Minority Leader, Haruna Iddrisu on what she thinks should be the judicial attitude to fighting galamsey in the country.

Appearing before the Appointments Committee of Parliament on Tuesday (18 October 2022), the appeals court judge, who is being considered for the Supreme Court of Ghana, said “… if I heard you right, you are asking about the judicial attitude [on galamsey] … we will determine if any case comes before us on the harmful nature of galamsey, we will look at the particular circumstances of each case and apply the law and make a determination. 

“But as a proponent of ADR, I think that the exception of the environmental matters in the ADR Act probably will have to look at again. So that we can try applying ADR mechanisms in resolving galamsey.” 

“… ADR will come in between the communities and the perpetrators if they are made to sit together and have a conversation…” she added.
