Jean Mensa, two others file suit to halt EC impeachment proceedings

The EC chair and her two deputies allege that a petitioner who is seeking to remove them from office has published details of the petition in the media, contrary to Article 146(8) of Ghana’s constitution

Jean Mensa, the chair of the Electoral Commission (EC), and her two deputies – Dr Bossman Eric Asare and Samuel Tettey – have filed a suit at the Supreme Court against the #FixTheCountry convenor Oliver Barker-Vormawor.

In a Facebook post on 10 January 2022, Barker-Vormawor shared a press statement describing how, together with 45 other individuals, he had petitioned the Office of the President to demand the removal of the three top EC officials for failing to organise parliamentary elections for the residents of Santrokofi, Akpafu, Lolobi and Likpe (SALL).

However, in a writ filed at the Supreme Court on Wednesday 26 January to invoke the court’s original jurisdiction, the plaintiffs are asking for five reliefs, including “a declaration that the airing of the contents of the petition by the first defendant to the media (traditional and social) has subjected the first, second and third plaintiffs to public ridicule, hatred, opium and opprobrium and equally exposed them to unfair prejudice”.

Injunction

The plaintiffs are also seeking “an order of perpetual injunction directed against the second defendant [Chief Justice Kwasi Anin Yeboah] from determining, dealing or having anything to do in any manner whatsoever and/or howsoever, with any issues arising out of the contents of [the] petitioners’ petition or at all”.

The Chief Justice and the Attorney General are also named as defendants in the case, which seeks to halt ongoing impeachment proceedings against the three top EC officials.
