Regressive judicial judgements hampering our work, says OSP

Addressing a news conference on Wednesday, the Special Prosecutor Kissi Agyebeng said the court cannot injunct the OSP from investigating anybody

The Office of the Special Prosecutor (OSP) has expressed disappointment over what it describes as “some regressive judgements”, which it says is having adverse effect on its operations in tackling corruption.

The OSP cited some development and instances in the case of the late Kwadwo Owusu Afriyie, CEO of Forestry Commission, Charles Bissue, a former presidential staffer and Cecilia Dapaah, former commissioner for the Customs Division of the Ghana Revenue Authority, Col. Kwadwo Damoah (rtd) and Cecilia Dapaah’s case as an example.

Addressing a news conference on Wednesday, the Special Prosecutor Kissi Agyebeng said the court cannot injunct the OSP from investigating anybody.

“There appears to be a developing trend of rather regressive and dismissive judicial decisions in respect of cases involving the Office of the Special Prosecutor with troubling consequences.

“And it seems to us at a careful examination of these outcomes portends a disturbing spectre that the fight against corruption is being hampered to the disbenefit of us all, and I do not say these things lightly,” he said.

“One case the OSP applied to the High Court for the confirmation of a freezing order in respect of a deceased person estate, the judge refused to confirm the order by in effect holding that the OSP had come too late, since the person of interest had died and that his death had distinguished the enquiry commenced after the occurrence of death,” Agyebeng added.
